Terms and Conditions

inDriver ("we," "us", the "Company", the "Promoter") offers you (the "Participant") an opportunity to earn rewards by registering as a "Driver" with the inDriver mobile application (the "App") and sharing your personal link to download the App with others and/or being designated as the referring person by the referred person (the "Referral) who will complete certain amount of rides using the App section named “inDriver.Freight” during the limited time period in the city of Almaty, Astana, Shymkent (Chymkent), Karaganda, Aktobe, Taraz, Atyrau, Aktau, Kyzylorda, Pavlodar, Uralsk, Semey, Turkestan, Ust-Kamenogorsk, Kostanay, Kokshetau, Taldykorgan, Ekibastuz, Temirtau, Zhanaozen, Saryagash, Kaskelen, Balkhash , Petropavlovsk, Rudny, Talgar, Zhezkazgan, Shuchinsk, Shu, Kulsary, Merke (Kazakhstan) ("Referral Program" or "Program").

These terms and conditions ("Terms") apply to Participant and Referral participation in the Program. Participation in the Program is considered acceptance of these terms, and Participant and Referral agree to use the Program as described herein, and consistent with any other terms we may apply to the Program. If you do not agree to these Terms, do not register and participate in the Program.

1. Promoter. The Promoter is inDriver. The Promoter can be contacted by emailing to support@indriver.com.

2. Promotion Period. The Promotion will commence at 00:00 AM (PST) on April 22, 2023 and will close at 23:59 PM (PST) December 31, 2023.

3. Eligibility.
3.1. To be eligible to receive a Promotional Offer the Participant must satisfy all of the following criteria:
- is at least 18 years old or more and has full legal capacity where they reside;
- is not a director, employee, driver acquisition agent or an immediate family member of a director or employee, of either the Promoter or its related entities. Immediate family member is classed as either a spouse or a partner, children, parents or other close relatives;
- has an existing, valid inDriver user account as a "Driver";
- agree to the Terms of this Promotion;
- provides their personal link to download the App and/or consent to the Referral providing the Promoter with their valid mobile phone number to enable the Promoter to acknowledge the referral (subject to the eligibility criteria being met).
3.2. The Referral must satisfy all of the following criteria:
- is at least 18 years old or more and has full legal capacity where they reside;
- is not a director, employee, driver acquisition agent or an immediate family member of a director or employee, of either the Promoter or its related entities. Immediate family member is classed as either a spouse or a partner, children, parents or other close relatives;
- does not have an existing, valid inDriver user account;
- agrees to the Terms of this Promotion;
- downloads and install the App through the provided personal link or will provides the Promoter with valid mobile phone number of the Participant in the section called "Referral Program" at https://promo.indrive.com/ru/freight (subject to the eligibility criteria being met);
- registers with the App and successfully completes the verification process to receive "Verified" status in the App if registering as a driver;
- completes the number of orders specified in Clause 4 during the Promotion Period using the App's section named “inDriver.Freight”.

4. Promotional Offer. Participant who fulfils the eligibility criteria in Clause 3 is eligible to receive the Promotional Offer as follows:
4.1. In case Referrals will register as a "Client" in the App, the Participant is eligible to receive:
- 23 000 tenge
in bonus coins for every 10 orders which have been completed by the Referrals in total, regardless of the number of orders completed by each Referral.
4.2. In case Referrals will register as "Drivers" in the App, the Participant is eligible to receive up to:
- 23 000 tenge
in bonus coins only if the Referral will complete 10 orders during the first 2 weeks after the registration and verification in the App.

5. Limitations and restrictions.
5.1. Promotional offer is only awarded to the Participant if both the Participant and the Referral simultaneously fulfil all the eligibility criteria mentioned in Clause 3.
5.2. A Participant who fulfils the eligibility criteria in Clause 3 is eligible to receive the promotional offer according to Clause 4.

6. Collection details.
6.1. The Promotional Offer will be awarded and available in the Participant’s individual user profile after completing the application form at https://promo.indrive.com/ru/freight with no restrictions or deadlines to use the promotional offer. Award of Promotional offer is subject to the eligibility requirements in Clause 3 having been satisfied and limitations in Clause 5.
6.2. Promotional Offer will be awarded after contacting the Promoter at support@indriver.com.
6.3. If the Participant fails to claim the Promotional Offer within 14 (fourteen) days from the time the promotional offer has become available or is found ineligible by the Promoter, the Promotional Offer will be forfeited.
6.4. Receipt of the Promotional Offer by the Participant is upon the condition of compliance with any and all federal, state, and local laws and regulations.
6.5. If the Participant and\or the Referral violates any of these Terms, the Participant (at the Promoter sole discretion) will be disqualified, and all privileges as the Participant will be immediately terminated.

7. Reward Non-refundable and Other Offers. There shall be no cash or other promotional offer substitution permitted. The promotional offer is non-transferable. The Participant and\or the Referral, upon acceptance of the promotional offer, are solely responsible for all expenses related to the promotional offer, including without limitation any and all local, state, and federal taxes. The Participant an\or the Referral shall not transfer assignment of the promotional offer to others nor shall the Participant and\or the Referral request the cash equivalent or promotional offer substitution. This Promotion is not available in conjunction with any other offers by the Promoter.

8. Release. To the extent permissible by law, the Participant and\or the Referral release the Promoter, its related entities, its and their respective directors, officers, employee, agents, its advertising agencies, advisers, nominated agents, suppliers, affiliates and/or associated companies from any causes of action, loss, liability, damage, expense (including any claim for legal expenses). The Promoter will not be responsible for any delayed, lost or misdirected mail or any other communication.

9. Force Majeure. The Promoter will not be responsible or liable for any loss, cost or damage arising out of any act, omission, failure or delay by the Promoter or other party which is due to an act of god, riots, acts of terrorism, storms, fire, any labour or industrial dispute, any strike, and other acts which are not reasonably within the control of the Promoter.

10. Privacy.
10.1. By entering this promotional competition, the Participant and\or the Referral agrees:
- the Participant and\or the Referral is willing to supply their contact details, including a valid mobile number;
- the Participant and\or the Referral agrees to the processing of their personal information in accordance with Privacy Policy https://podval.console3.com/mobile/page/privacyPolicy/ru;
- the Participant and\or the Referral agrees to receive marketing material from the Promoter.
10.2. Each Participant and\or Referral who enters the Program, authorises the Promoter to collect, store and use their personal information for the purposes of verifying eligibility criteria in accordance with Clause 3, as well as an entry mechanism, for communication, announcements, and/or statistical purposes. The personal information collected will be stored by the Promoter after the conclusion of the Program for such period and to the extent permitted by law (for the duration of the Promotion Period). Participants and\or the Referrals can opt out of future communications at any given time.
10.3. By accepting the promotional offer, the Participant and\or the Referral grants permission for the Promoter to use the Participant and\or the Referral submission, name, photo, likeness, image, statements about the Program, and your information (provided for registration) for news, publicity, advertising, promotional purposes, information, and public relations without any further notice, review, consent, compensation, or remuneration, unless prohibited by law.

11. Program Cancellation and Modification. In its sole discretion, the Promoter reserves the right to modify, suspend, cancel, or terminate the Program should non-authorized human intervention, a bug or virus, fraud, or other causes beyond the Promoter’s control, impact or corrupt the security, fairness, proper conduct, or administration of the Program. The Promoter, in the event of any of the above issues, may determine the eligible Participant and\or Referral based on all eligible entries received prior to and/or after (if appropriate) the action taken by the Promoter. Individuals who tamper with or attempt to tamper with the operation or entry process of the Program or website or violates these Terms will be disqualified by the Promoter in its sole discretion. In its sole discretion, the Promoter has the right to maintain the integrity of the Program, including, but not limited to: identify any disallowed entry methods that will result in entries being voided; examples: multiple entries from the same user; multiple entries from the same computer/device beyond the number allowed by the Program rules; or the use of bots, macros, scripts, or other technical means for entering. Attempts by any Participant or Referral to deliberately damage any website or undermine the legitimate operation of the Program may be a violation of criminal and civil laws. If any such attempt is made, the Promoter reserves the right to seek damages to the fullest extent permitted by law.

12. Disputes. This Program is governed by the applicable laws, with respect to conflict of law doctrines. The Participant and\or the Referral agrees, as a condition of participating in this promotion, that if any disputes cannot be resolved between the Participant and\or the Referral and the Promoter, and if causes of action arise out of or are connected with this Program, they shall be individually resolved exclusively before the Nicosia District Court, without resorting toni any form of class action. Under no circumstances in any such dispute shall the Participant and\or the Referral be permitted to obtain awards for, and hereby waives all rights to punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than Participant and\or the Referral actual out-of-pocket expenses (i.e. costs associated with entering this Program). The Participant and\or the Referral waives all rights to have damages multiplied or increased.
13. In the event of a discrepancy between promotional material (or any other sources of information digital or print) and these Terms, these Terms shall prevail.
